Damon Eisenbrey
Founder & Managing Attorney, Eisenbrey Law
Damon Eisenbrey is a litigation attorney with 25 years of experience representing businesses, healthcare providers, and individuals in state and federal courts, arbitrations, mediations, administrative proceedings, and investigations.
For more than a decade, his practice has concentrated on representing substance use disorder and mental health treatment providers, clinical laboratories, and sober living operators. He advises and represents clients in insurance coverage and reimbursement disputes, payer investigations, regulatory compliance, healthcare fraud matters, and business disputes.
Experience in Provider Litigation
Damon has led complex, consolidated litigation against major commercial insurers involving multiple providers, more than 1,000 patients, and hundreds of thousands of healthcare claims. His experience spans self-funded and fully insured health plans, third-party administrators, and repricing and payment-integrity vendors.
Throughout his career, he has recovered tens of millions for healthcare provider clients and obtained significant discovery and summary judgment rulings. His work has included challenges to insurer defenses involving assignments of benefits, administrative exhaustion, and contractual limitation periods, as well as defending providers against counterclaims involving allegations of healthcare fraud, patient brokering, improper premium payments, and unlawful referral arrangements.
He has also obtained discovery concerning payer fee structures, executive communications, and financial incentives affecting reimbursement; defended providers in Special Investigation Unit investigations; and challenged local ordinances affecting treatment facilities and sober living homes.
Damon’s commitment to behavioral healthcare is personal as well as professional. As a person in recovery with firsthand experience receiving treatment, he understands the importance of effective care and the role providers and insurers play in helping people recover and rebuild their lives.
That perspective informs his commitment to substance use disorder and mental health treatment providers and his appreciation for the challenges they face.
